NA adopts amended Government Organisation Law

The law consists of seven chapters and 50 articles and will come into effect at the beginning of 2016.

The newly-approved law specifies the maximum number of deputy ministers and deputy heads of ministerial-level agencies.

Accordingly, the number of deputy ministers and deputy heads of ministerial-level agencies shall not exceed five, while the positions for Ministry of Defense, Ministry of Public Security, and Ministry of Foreign Affairs should not exceed six. In the case of ministry or ministerial-level agencies merging or the reallocation of officers, the Prime Minister will submit the personnel plan to the NA Standing Committee for consideration and decision.

A report by Chairman of NA Law Committee Phan Trung Ly stated that, gathering opinions and suggestions from NA deputies, the draft law has been supplemented and revised to clarify the responsibility of the government, the Prime Minister, ministers, and heads of ministerial-level agencies to match their tasks and powers assigned, as well as their responsibility to the Party, State and people, and their responsibility in the organisation of the operating their managed bodies.

The law added a new provision: "The government is responsible under the NA for its decisions and its policies; for the results, effectiveness, management and administration of the State administrative apparatus, and for their proposals to authorised agencies ".

The Prime Minister is responsible to the NA for the activities of government and State administrative system from the central to local levels, for his/her decisions and results of implementing such decisions within his/her assigned duties and power, while been directly involved in Q&A sessions during NA and NA Standing Committee’s sittings.

The law also supplements an additional provision requiring ministers and heads of ministerial-level agencies to take responsibility for the results, effectiveness and performance of ministries and ministerial-level agencies; for decisions and results of the implementation of such decisions within their tasks and powers assigned; and for directly taking part in NA and NA Standing Committee’s Q&A sessions.

The NA Standing Committee suggested the NA implement several additional related contents on the issue of “promoting personal responsibility of heads of agencies" along with the notion that "subordinate bodies must obey the leadership and strictly abide by the decisions of the superior authorities" to clarify the characteristics in the organisation and operation of State administrative agencies.

Also at the morning session, NA deputies ratified the Law on Local Government Organisation with 85.22% of deputies in favour.
